- Purposely with prior calculation and design cause death of another or unlawful termination of another's pregnancy.
- Purposely cause death of another or unlawful term of another's pregnancy while committing or attempting, or fleeing immediately after kidnapping, rape, aggravated arson, arson, aggravated robbery, robbery, aggravated burglary, burglary, trespass occupied structure, terrorism or escape.
- purposely cause death of another under 13 years at time of offense.
- Under detention or breaks detention having found/pleaded guilty to a felony purposely cause death of another.
- Purposely cause death of LEO and knows or reasonable cause to know is a LEO if either VIC is engaged in their duties or offender's specific purpose to kill a LEO.
- Purposely cause deathh of a 1st Responder or Military member when offender knows, has reasonable cause to know or specific purpose to kill.

(A)-Purposely cause death of another or unlawful term another's pregnancy (B)-Cause death of another as a proximate result of the offender's committing or attempting to commit an offense of violence that is a felony 1 or 2 and not a violation of 2903.03 (Vol Mans) or 2903.04 (Invol Mans). (C)-DOES NOT APPLY if predicating offense is a F1 or F2 as a result of previous charges causing such to escalate. |
