a. First time offenders; b. Misdemeanor amounts between $25 & $299; c. In possession of valid ID; d. The offender must admit to the offense; e. The offender must willingly participate in the program; and f. The offender must be truthful throughout the investigation |

a. Walmart will report the failure to JSO; b. An officer will respond and investigate; c. The officer will complete a General Offense report documenting the retail theft; d. The officer will respond to the SAO and attempt to secure a warrant for the suspect’s arrest; e. If a warrant is secured, the officer will make a physical arrest of the suspect and complete a Supplement Report clearing the case by arrest; and f. If the warrant is refused by the SAO, the officer will complete a Supplement Report exceptionally clearing the case. |

Officers enforcing MO 614.138 should contact NCIC who will call the designated Homeless Shelter Capacity Coordinator at (904) 394-1362/394-1356 to determine the availability of bed space and comply with provisions of the MO; and b. The violator must refuse to accept lodging at any homeless shelter in the city. |
