The New Jersey Plan- Small states plan that the unicameral made big states and small states equal when it comes to voting.

One State..... one vote

Virginia's vote would be the same as New Jersey's vote even though Virginia has a bigger popultation.

McCullouch v. Maryland - Maryland wanted to tax the national bank and McCullouch found that by Maryland taxing the banks it would be impeading upon the federal government. So congress gave the federal government authority over state government.The power to tax is the power to destroy.

Propose amendments to the U.S. Constitution.

Initiatives are petitions that you have to get 8% of the voters in the last state wide election to vote on and 6 of the 9 congressional members to get the amendment proposed to go for ratification. Then it is ratified by majority vote.

Selection of Judges

There must first be a vacancy and then the Governor calls the judicial nominating committee made up of 3 non-lawyers picked by the governor and 3 lawyers voted upon by the Missouri Bar Association. They then nominate 3 people other than themselves. The Governor picks one of those 3 then after one year there is a retention election so that the people can vote to keep the judge or expire his term.

Griswold v. Conneticutt

Conneticutt had a law that made the distribution of contraceptives illegal. Even though privacy is not listed in the Constitution, the government can not come in and intrude on yoru private life. They still feel that privacy is a part of the constitutional rights.

Mapp v. Ohio

This case dealt with the exclusionary rule and established the right to search and seizure by the government having to have a search warrant when conducting any type of search for evidence. Evidence found in an illegal search and seizure is excluded from a court case. A search warrant entails: the purpose of the search, what they are searching for, and why they are searching for the item they are searching for.

Machiavelli

Madison was a key framer in the writings of the consitution. Lasswell, Easton and Madison explain why these are not the answer.

Slavery--

Southern states wanted slaves to count as full votes for the purpose of population not taxation. Northern states wanted them to count for taxes not population. So they came up with the 3/5s compromise that counted the slaves' votes for 3/5s of a vote for population and taxation. Big state/Small state controversy didn't really resolve the slavery problem but it did come up with the 3/5s resolution that led to the civil war.

McCulloch v. Maryland-

Maryland wanted to tax the national banks but this went against the federal government powers. The ruling established the fact that the federal government has enumerated power so the state can not over rule that power.

Governor-

Ultimately picks the one judge that will be the judge for that year.

The Virginia Plan

the lower house is based on population. The lower house picks the upper house. Big states could control everything by getting the power over the lower house.

The New Jersey Plan

The unicameral chose president in this plan. One state one vote.

State Legislature

3/4 of the state legislature to ratify an amendment.

Farmers-

The farmers could not pay their mortgages and had no one to turn to resolve the problem, so the banks would foreclose on the farms. So the farmers went and fought the banks with shotguns and forkpitch's at the banks front step where the foreclosure auction would be taking place and wouldn't let it happen.
